ACROMINDS TERMS AND CONDITIONS

1. About These Terms

AcroMinds is a service operated by:

EC Academy Pte. Ltd.
UEN: 201937539N

In these Terms and Conditions, “AcroMinds”, “EC Academy”, “we”, “us” and “our” refer to EC Academy Pte. Ltd., operating under the AcroMinds service brand.

These Terms and Conditions govern:

  • your use of www.acrominds.com;

  • enquiries, registrations and bookings made with AcroMinds;

  • participation in AcroMinds classes, camps, workshops, coaching sessions, events and programmes;

  • purchases of AcroMinds products or services; and

  • communications and transactions between you and AcroMinds.

By accessing our website, making a booking, registering a participant, purchasing a service or allowing a child to participate in an AcroMinds programme, you agree to these Terms and Conditions.

Where a registration form, programme page, invoice, quotation or confirmation message contains additional programme-specific terms, those terms will form part of your agreement with us.

If there is a conflict between these Terms and programme-specific terms, the programme-specific terms will apply to that particular programme or booking.

Nothing in these Terms excludes or restricts any consumer right or legal remedy that cannot lawfully be excluded under Singapore law.

2. Parent or Guardian Responsibility

Registrations for participants below 18 years of age must be made or authorised by a parent, legal guardian or authorised adult.

By registering a child or participant, you confirm that:

  • you are legally authorised to register the participant;

  • the information you provide is accurate, complete and current;

  • you accept these Terms on behalf of yourself and, where legally permitted, the participant;

  • you will disclose relevant medical, behavioural, developmental, learning or accessibility needs;

  • you will inform us promptly if any relevant information changes;

  • you will ensure that the participant follows reasonable programme and safety instructions; and

  • you or an authorised emergency contact will remain contactable during the programme.

3. Nature of AcroMinds Programmes

AcroMinds provides programmes for children and teenagers that may include:

  • parkour and parkour-inspired activities;

  • physical movement and fitness activities;

  • gymnastics or movement-based activities;

  • outdoor classes;

  • games and group challenges;

  • mindset and life-skills coaching;

  • communication and social-emotional activities;

  • workshops;

  • holiday camps;

  • private or small-group coaching;

  • educational activities; and

  • related events and programmes.

Programme descriptions are intended to provide a general overview.

Activities, schedules, coaches, venues, equipment, groupings and programme content may be adjusted where reasonably necessary for safety, participant needs, weather, staffing, venue availability or operational reasons.

Participation does not guarantee any particular educational, physical, behavioural, emotional, sporting or developmental outcome.

AcroMinds does not provide medical, psychiatric, psychological or therapeutic treatment unless this is expressly stated and delivered by an appropriately qualified professional.

4. Programme Eligibility and Suitability

Some programmes may have requirements relating to:

  • age;

  • physical ability;

  • experience level;

  • medical suitability;

  • behavioural readiness;

  • developmental needs; or

  • the participant’s ability to follow instructions safely.

We may assess whether a programme is reasonably suitable for a participant.

We may recommend:

  • a different class or age group;

  • a trial session;

  • additional supervision;

  • programme modifications;

  • medical clearance; or

  • another programme that may be more suitable.

We may decline or discontinue participation where we reasonably believe that we cannot safely or appropriately meet the participant’s needs.

Where possible, we will discuss concerns with the parent or guardian before making such a decision.

5. Registration and Booking Confirmation

Submitting a registration form, enquiry or payment does not necessarily guarantee a place.

A registration is confirmed only when AcroMinds:

  • provides written confirmation;

  • issues a confirmed booking;

  • accepts the applicable payment; or

  • otherwise informs you that the participant’s place has been secured.

Places may be offered on a first-come, first-served basis unless otherwise stated.

We may place participants on a waiting list where a programme is full.

We may decline or cancel a registration where:

  • the programme is full;

  • the participant does not meet the stated requirements;

  • required information has not been provided;

  • payment has not been received;

  • inaccurate or misleading information has been provided;

  • we cannot reasonably accommodate the participant safely;

  • the participant’s involvement may create an unreasonable safety risk; or

  • another legitimate operational reason applies.

Where we decline a registration before the programme begins, fees paid for the affected registration will generally be refunded.

However, administrative or third-party costs may be deducted where permitted by law and where the cancellation resulted from false, misleading or materially incomplete information supplied during registration.

6. Fees and Payment

All fees are stated in Singapore dollars unless otherwise indicated.

You must pay the applicable fees by the stated deadline and through an accepted payment method.

A participant’s place may not be secured until full payment or an agreed deposit has been received.

Additional charges may apply for items or services such as:

  • extended programme hours;

  • transport;

  • meals;

  • merchandise;

  • uniforms;

  • equipment;

  • special activities;

  • replacement items;

  • late registration; or

  • late collection.

Any additional charge will be communicated before it is imposed.

We may release, suspend or cancel a booking if payment is not received by the required deadline.

You are responsible for transaction charges imposed by your bank, card provider or payment platform.

7. Promotions and Discount Codes

Promotions, discounts and promotional codes:

  • are subject to availability;

  • may have specific eligibility requirements;

  • may have an expiry date;

  • cannot ordinarily be exchanged for cash;

  • cannot be used retrospectively;

  • may not be combined with other promotions unless expressly permitted; and

  • may be withdrawn or amended before a booking is confirmed.

We may reject the use of a promotion or discount where we reasonably believe it has been used incorrectly, unlawfully or contrary to its stated conditions.

8. Cancellations and Withdrawals by Customers

Cancellation and withdrawal conditions may differ between programmes.

The cancellation and refund policy displayed on the relevant programme page, booking form, invoice, quotation or confirmation message will apply to the booking.

Unless otherwise stated in writing:

  • cancellation requests must be made in writing;

  • non-attendance does not automatically qualify for a refund, credit or replacement session;

  • missed sessions are not automatically transferable or replaceable;

  • unused programme sessions cannot ordinarily be exchanged for cash;

  • administrative and third-party booking charges may be non-refundable where permitted by law; and

  • credits may have an expiry date and may not be transferred to another person without approval.

Any refund, credit or replacement session offered by AcroMinds is subject to the relevant programme policy and applicable Singapore law.

9. Illness, Injury and Exceptional Circumstances

We may consider requests relating to serious illness, injury, hospitalisation, bereavement or other exceptional circumstances on a case-by-case basis.

We may request supporting documentation, such as:

  • a medical certificate;

  • a doctor’s letter;

  • hospital documentation; or

  • other reasonable evidence.

The provision of supporting documentation does not automatically guarantee a refund, credit or replacement session.

Where appropriate, we may offer:

  • a replacement session;

  • a programme transfer;

  • a partial credit;

  • a future programme credit; or

  • another reasonable arrangement.

10. Transfers and Replacement Participants

Bookings may not be transferred to another person without prior written approval from AcroMinds.

Where a transfer is permitted:

  • the replacement participant must satisfy the programme requirements;

  • updated registration and medical information must be provided;

  • an administrative fee may apply if disclosed in advance; and

  • the transfer must be completed before the stated deadline.

Programme credits and promotional places are not transferable unless expressly approved.

11. Programme Changes by AcroMinds

We may make reasonable changes to a programme’s:

  • coach or instructor;

  • venue;

  • date or time;

  • activity sequence;

  • group arrangement;

  • equipment;

  • duration;

  • format; or

  • programme content.

Changes may be made because of:

  • safety concerns;

  • participant needs;

  • weather conditions;

  • staffing issues;

  • venue availability;

  • enrolment numbers;

  • government requirements;

  • equipment availability; or

  • operational needs.

Where a material change occurs, we will take reasonable steps to notify the registered contact.

A change of coach, activity sequence or similar operational detail will not ordinarily entitle a customer to a refund, provided that the essential nature of the programme remains substantially the same.

12. Programme Cancellation or Postponement by AcroMinds

We may cancel, postpone, shorten, relocate or reschedule a programme because of:

  • insufficient enrolment;

  • coach illness or unavailability;

  • venue closure;

  • unsafe weather;

  • lightning risk;

  • poor air quality or haze;

  • public-health requirements;

  • government directions;

  • equipment or facility issues;

  • emergencies; or

  • circumstances beyond our reasonable control.

Where we cancel a programme and do not provide a reasonable replacement, rescheduled session or equivalent arrangement, affected customers will generally receive a refund or credit for the cancelled portion.

We are not responsible for indirect expenses such as:

  • transport costs;

  • accommodation;

  • meals;

  • lost working time;

  • childcare arrangements; or

  • other consequential costs,

except where liability cannot legally be excluded.

13. Health and Medical Information

Parents and guardians must provide complete and accurate information about anything that may affect safe participation, including:

  • medical conditions;

  • asthma;

  • allergies;

  • medication;

  • recent illness;

  • recent injuries;

  • physical limitations;

  • sensory needs;

  • behavioural or emotional needs;

  • learning or developmental needs;

  • accessibility requirements; and

  • any advice provided by a doctor or medical professional.

You must update us promptly if this information changes.

Participants should not attend if they are:

  • unwell;

  • contagious;

  • experiencing symptoms that may place others at risk;

  • medically unfit to participate; or

  • unable to participate safely.

We may require medical clearance before permitting a participant to begin or return to a programme.

Our coaches and staff do not diagnose medical conditions.

A participant may be asked to:

  • stop an activity;

  • rest;

  • modify their participation;

  • see a nurse;

  • obtain medical attention; or

  • leave the programme,

where we reasonably believe this is necessary for their safety or the safety of others.

14. Medication

Medication should ordinarily be administered by a parent, guardian, school nurse or appropriately authorised person.

Where AcroMinds has agreed in advance to assist with medication, the parent or guardian must provide:

  • written instructions;

  • clearly labelled medication;

  • the correct dosage;

  • relevant medical information;

  • emergency instructions; and

  • any required authorisation.

We may decline to store or administer medication where staff are not appropriately trained, authorised or equipped to do so.

Participants must not share medication with others.

Emergency medication, such as an inhaler or adrenaline auto-injector, should be clearly labelled and readily accessible in accordance with instructions provided by the parent or guardian.

15. First Aid and Emergency Medical Care

If a participant becomes unwell, is injured or requires urgent assistance, you authorise AcroMinds and its staff to:

  • provide reasonable first aid;

  • contact the registered parent, guardian or emergency contact;

  • refer the participant to a nurse or medical professional;

  • contact emergency services;

  • arrange transport for medical assessment where reasonably necessary; and

  • disclose relevant information to medical professionals, insurers, emergency responders or authorities.

We will attempt to contact the registered parent, guardian or emergency contact as soon as reasonably practicable.

Where urgent treatment is reasonably necessary and a parent or guardian cannot be reached, AcroMinds may act in what it reasonably believes to be the participant’s best interests.

The parent or guardian is responsible for ambulance, medical, hospital, transport and related costs unless those costs arose from liability that AcroMinds is legally required to bear.

16. Incident and Wellness Reports

AcroMinds may prepare an incident, accident or wellness report where a participant:

  • experiences an injury;

  • reports pain, discomfort or illness;

  • requires an extended period of rest;

  • is referred to a nurse or medical professional;

  • is involved in a behavioural or safety incident; or

  • is unable to continue normal participation.

These reports may be retained for safety, operational, insurance and legal purposes.

Relevant information may be provided to a parent, guardian, doctor, nurse, insurer or authority where reasonably necessary and permitted by law.

17. Physical Activity and Ordinary Risks

Some AcroMinds programmes involve activities such as:

  • running;

  • jumping;

  • balancing;

  • climbing;

  • hanging;

  • swinging;

  • vaulting;

  • rolling;

  • landing;

  • outdoor play;

  • group games; and

  • contact with sports or movement equipment.

These activities involve ordinary and foreseeable risks, which may include:

  • slips, trips and falls;

  • bruises and abrasions;

  • strains and sprains;

  • collisions;

  • fatigue;

  • muscle soreness;

  • minor injuries;

  • exposure to weather; and

  • other injuries that may occur despite reasonable supervision and safety measures.

By registering a participant, you acknowledge the ordinary risks associated with the activities described for the programme.

This acknowledgement does not exclude or limit liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.

18. Safety Instructions

Participants must:

  • follow instructions given by coaches and staff;

  • use equipment only as directed;

  • remain within designated programme areas;

  • wear suitable clothing and footwear;

  • avoid dangerous, reckless or disruptive conduct;

  • inform staff if they feel unwell, tired, injured or unsafe;

  • avoid attempting skills that have not been approved by the coach; and

  • treat other participants, staff, venues and property respectfully.

Parents and guardians must ensure that participants arrive with any required:

  • clothing;

  • footwear;

  • water;

  • medication;

  • sun protection;

  • rain protection; or

  • equipment.

We may modify, restrict or stop a participant’s activities where reasonably necessary for safety.

19. Participant Behaviour

AcroMinds aims to provide a safe, respectful and supportive environment.

Participants must not engage in:

  • bullying;

  • harassment;

  • intimidation;

  • discriminatory or abusive language;

  • violence or threats;

  • deliberate damage to property;

  • persistent refusal to follow safety instructions;

  • conduct that places themselves or others at unreasonable risk;

  • unauthorised photography or recording;

  • theft;

  • possession of dangerous or unlawful items; or

  • serious disruption of programme activities.

Where concerns arise, we may:

  • speak with the participant;

  • issue a warning;

  • modify the participant’s activities;

  • separate participants;

  • contact the parent or guardian;

  • require early collection;

  • temporarily suspend participation; or

  • permanently remove the participant from the programme.

Where removal results from serious misconduct, repeated unsafe behaviour or materially incomplete information supplied during registration, fees may not be refundable, subject to applicable law.

20. Inclusion and Additional Support

We aim to make reasonable efforts to support participants with additional needs where we have been informed of those needs in advance.

However, AcroMinds may not always have the staffing, facilities, qualifications or resources required to provide individualised or one-to-one support.

Parents and guardians must disclose relevant information before registration so that we can assess whether reasonable adjustments can be made.

Where additional support is required, participation may be subject to:

  • a discussion with the parent or guardian;

  • a trial session;

  • a support plan;

  • additional staffing arrangements;

  • a suitable support person attending; or

  • additional charges agreed in advance.

21. Arrival, Attendance and Late Arrival

Participants should arrive at the time and location stated in the programme information.

Late arrival may result in:

  • the participant missing safety instructions or warm-up activities;

  • restricted participation in certain activities; or

  • refusal of entry where joining late would create a safety or operational concern.

No refund or credit will ordinarily be provided for time missed because of late arrival.

Parents and guardians must follow all stated check-in and attendance procedures.

22. Collection and Authorised Persons

Parents and guardians are responsible for ensuring that participants are collected at the stated time and location.

A child will only be released to:

  • a registered parent or guardian;

  • an authorised collector; or

  • the child independently, where written permission has been provided and AcroMinds has agreed to the arrangement.

We may request identification before releasing a child.

Changes to collection arrangements must be communicated through an approved method.

AcroMinds may refuse to release a participant to a person where:

  • the person is not authorised;

  • their identity cannot be reasonably confirmed;

  • they appear unable to care for the child safely; or

  • releasing the child may create a safety concern.

23. Late Collection

Where a participant is collected late:

  • we will attempt to contact the registered contacts;

  • the participant will remain under reasonable supervision;

  • a late collection fee may apply where disclosed in advance; and

  • repeated late collection may affect future participation.

If no authorised adult can be contacted within a reasonable period, we may contact the appropriate authorities where necessary to protect the child.

24. Outdoor Activities and Weather

Outdoor programmes may proceed during light rain or other manageable weather conditions.

Activities may be modified, delayed, relocated, postponed or cancelled because of:

  • lightning;

  • heavy rain;

  • haze;

  • poor air quality;

  • extreme heat;

  • unsafe surfaces;

  • damaged equipment;

  • government advisories; or

  • other safety concerns.

Safety decisions will be made by AcroMinds based on the information reasonably available at the time.

Participants should attend with appropriate clothing, footwear, hydration and weather protection.

25. Personal Belongings

Participants are responsible for their personal belongings.

Valuable items should not be brought to programmes unless necessary.

Items should be clearly labelled where appropriate.

To the maximum extent permitted by law, AcroMinds is not responsible for loss, theft or damage to personal belongings unless caused by our failure to exercise reasonable care.

Unclaimed items may be retained for a reasonable period and then donated, recycled or disposed of.

26. Damage to Property

Parents and guardians may be required to pay reasonable repair or replacement costs where a participant deliberately or recklessly damages:

  • programme equipment;

  • venue property;

  • another participant’s belongings; or

  • AcroMinds property.

Normal wear and tear or accidental damage that occurs despite appropriate conduct will be considered separately.

27. Photographs, Videos and Recordings

AcroMinds may photograph or record programmes for purposes including:

  • programme documentation;

  • participant assessment;

  • safety review;

  • incident review;

  • staff training;

  • internal communication; and

  • marketing or publicity.

The collection and use of photographs and recordings will be handled in accordance with the AcroMinds Privacy Policy and any applicable consent requirements.

Where marketing consent has not been provided, we will take reasonable steps not to intentionally publish identifiable images of the participant for promotional purposes.

Parents, guardians, participants and visitors must not photograph, film or publish identifiable images of other children without appropriate permission.

Recording may be restricted or prohibited during certain programmes.

28. Online Programmes

For online classes, coaching sessions, meetings or workshops:

  • participants must use a suitable device and internet connection;

  • parents and guardians are responsible for the participant’s physical environment and appropriate supervision;

  • meeting links must not be shared with unauthorised persons;

  • sessions must not be recorded without written permission;

  • participants must behave respectfully; and

  • we may remove a participant who creates a safety, privacy or behavioural concern.

We are not responsible for disruption caused by a participant’s device, internet connection or third-party platform.

Where a substantial session disruption arises from systems controlled by AcroMinds, we may provide a reasonable alternative or replacement arrangement.

29. Website Use

You may use www.acrominds.com only for lawful purposes.

You must not:

  • interfere with the website’s operation or security;

  • attempt to gain unauthorised access to systems or information;

  • introduce viruses, malware or harmful code;

  • scrape or automatically extract website content;

  • impersonate another person;

  • submit false or misleading information;

  • use the website to harass or harm another person;

  • copy or exploit website content for commercial purposes without permission; or

  • use the website in a way that violates applicable law.

We may restrict, suspend or terminate access where these Terms are breached.

30. Intellectual Property

Unless otherwise stated, EC Academy Pte. Ltd., AcroMinds or their licensors own the intellectual-property rights in:

  • the AcroMinds name and branding;

  • logos;

  • website content;

  • photographs and videos;

  • graphics and illustrations;

  • programme frameworks;

  • lesson plans;

  • coaching materials;

  • activity formats;

  • assessments;

  • worksheets;

  • downloadable resources; and

  • other programme content.

You may access programme materials only for the participant’s personal and non-commercial use.

You must not, without prior written permission:

  • reproduce;

  • modify;

  • publish;

  • distribute;

  • sell;

  • licence;

  • teach from;

  • upload;

  • commercially exploit; or

  • create derivative products from

AcroMinds materials.

Participation in an AcroMinds programme does not transfer ownership of any intellectual property.

31. Third-Party Services and Links

Our website and programmes may use or link to third-party services, including:

  • payment platforms;

  • booking systems;

  • maps;

  • video-conferencing platforms;

  • social media platforms;

  • venue operators; and

  • external websites.

Third parties operate under their own terms and privacy policies.

AcroMinds is not responsible for the content, security, availability or conduct of third-party platforms outside our reasonable control.

A link to a third party does not necessarily constitute endorsement.

32. Website Information and Availability

We take reasonable steps to keep website information accurate and current.

However:

  • programme information may change;

  • typographical errors may occur;

  • availability may change before a booking is confirmed;

  • content may not always be complete or current; and

  • the website may occasionally be unavailable.

We may correct errors, update information, withdraw content or suspend website access where reasonably necessary.

33. Liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Singapore law.

Subject to that qualification and to the maximum extent permitted by law, AcroMinds and EC Academy Pte. Ltd. will not be liable for:

  • indirect or consequential loss;

  • loss of income, profit, opportunity or anticipated savings;

  • loss caused by inaccurate, incomplete or outdated information provided by a parent, guardian or participant;

  • loss resulting from a participant’s failure to follow reasonable instructions;

  • loss caused by a participant’s unsafe or unauthorised conduct;

  • loss arising from circumstances beyond our reasonable control; or

  • loss relating to third-party platforms or services outside our control.

Where AcroMinds is legally liable in connection with a particular booking, our aggregate liability will, to the extent permitted by law, be limited to the amount paid for the affected programme.

This limitation does not apply to:

  • fraud;

  • wilful misconduct;

  • death or personal injury caused by negligence; or

  • any liability that cannot legally be excluded or limited.

34. Responsibility for Breaches and Damage

To the extent permitted by law, you are responsible for reasonable and direct losses suffered by AcroMinds as a result of:

  • your unlawful use of the website;

  • a material breach of these Terms;

  • deliberate or reckless damage caused by you or the participant; or

  • false or materially misleading information supplied by you.

You will not be responsible for losses caused by AcroMinds’ own negligence, misconduct or breach of law.

35. Events Beyond Our Reasonable Control

AcroMinds is not responsible for delay or failure caused by circumstances beyond our reasonable control, including:

  • natural disasters;

  • severe weather;

  • haze;

  • epidemics or pandemics;

  • public-health restrictions;

  • government actions;

  • venue closures;

  • transport disruption;

  • utility or internet failure;

  • civil disturbance;

  • labour disruption; or

  • other emergencies.

Where reasonably possible, we will take steps to minimise disruption and may provide an alternative arrangement, rescheduling, credit or refund depending on the circumstances and applicable law.

36. Privacy and Personal Data

Our collection, use, disclosure, storage and protection of personal data are governed by the AcroMinds Privacy Policy.

The Privacy Policy forms part of these Terms and is available at www.acrominds.com.

37. Complaints and Feedback

Questions, concerns or complaints should first be directed to:

Please include:

  • your name;

  • the participant’s name, where relevant;

  • the programme involved;

  • the relevant dates; and

  • a clear description of the issue.

We will seek to review and resolve complaints fairly and within a reasonable period.

38. Dispute Resolution

Where a dispute arises, both parties should first attempt to resolve the matter through direct and good-faith discussion.

Where appropriate, the parties may consider mediation or another mutually agreed dispute-resolution process before commencing court proceedings.

Nothing in this clause prevents either party from exercising a legal or statutory right.

39. Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore.

Subject to applicable statutory rights, the courts of Singapore will have jurisdiction over disputes arising from:

  • these Terms;

  • use of the AcroMinds website;

  • an AcroMinds booking; or

  • participation in an AcroMinds programme.

40. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • our programmes;

  • operational requirements;

  • safety procedures;

  • business practices;

  • applicable law; or

  • regulatory requirements.

Updated Terms will be published on www.acrominds.com with a revised “Last updated” date.

Changes will not ordinarily apply retrospectively to a confirmed booking unless:

  • required by law;

  • necessary for safety;

  • agreed by the customer; or

  • the change does not materially disadvantage the customer.

41. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue in full force and effect.

42. No Waiver

A failure or delay by AcroMinds to exercise a right under these Terms does not constitute a waiver of that right.

A waiver will only be effective if provided in writing by an authorised representative of EC Academy Pte. Ltd.

43. Entire Agreement

These Terms, together with:

  • the AcroMinds Privacy Policy;

  • the applicable registration form;

  • programme-specific terms;

  • written quotations;

  • invoices; and

  • booking confirmations,

form the agreement between you and EC Academy Pte. Ltd. concerning the relevant AcroMinds service.
